Definition of teleworking according to CSSF Circular 21\/769<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4b086bc4 elementor-widget-divider--view-line elementor-invisible elementor-widget elementor-widget-divider\" data-id=\"4b086bc4\" data-element_type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;fadeIn&quot;,&quot;_animation_delay&quot;:300}\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-540ccbf elementor-widget elementor-widget-text-editor\" data-id=\"540ccbf\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Circular CSSF 21\/769 introduces <strong>Cumulative conditions for defining the concept of teleworking<\/strong> :<\/p><ol><li>The work must be provided by means of <strong>information and communication technologies<\/strong> (TIC) on <strong>accord <\/strong>preliminary of the\u2019<strong>employer<\/strong> ;<\/li><li>remote working basis <b>voluntary base<\/b> (it is advisable to obtain the express and informed consent of the employee); ;<\/li><li>The tasks must be carried out within the framework of <strong>working hours<\/strong> defined and in a <strong>Predetermined place different from the employer's premises<\/strong>.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1af7245b elementor-widget elementor-widget-text-editor\" data-id=\"1af7245b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The work must be provided as part of the\u2019<strong>normal company activity<\/strong>. Any task carried out as part of the activation of a BCP\/DRP or in exceptional circumstances (such as the Covid-19 pandemic) does not fall within the definition of remote working and is therefore not covered by CSSF Circular 21\/769.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ce67384 elementor-widget elementor-widget-spacer\" data-id=\"ce67384\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-55e95153 elementor-widget elementor-widget-heading\" data-id=\"55e95153\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">3. Central administration<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-14f2b7c5 elementor-widget-divider--view-line elementor-invisible elementor-widget elementor-widget-divider\" data-id=\"14f2b7c5\" data-element_type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;fadeIn&quot;,&quot;_animation_delay&quot;:300}\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-519f87c elementor-widget elementor-widget-text-editor\" data-id=\"519f87c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In order to comply with the requirements for\u2019<strong>Central administration<\/strong> :<\/p><ul><li>The entity must be able to <strong>prove<\/strong> that its headquarters remain the decision-making centre; ;<\/li><li>At least<strong> A Responsible Person must be present<\/strong> at the company's registered office at any time; ;<\/li><li>The <strong>key functions must be represented<\/strong> face-to-face daily ;<\/li><li>The staff must be able to get to the <strong>premises<\/strong> of society in the most <strong>short deadlines<\/strong> ;<\/li><li>The <strong>name<\/strong> people operating in remote work environments <strong>simultaneous<\/strong> must be <strong>Limited<\/strong> ;<\/li><li>The <strong>duration<\/strong> remote working granted to each person must be <strong>limited<\/strong> ;<\/li><li>The <strong>Continuity<\/strong> des activit\u00e9s critiques doit \u00eatre <strong>assured.<\/strong><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2b600843 elementor-widget elementor-widget-spacer\" data-id=\"2b600843\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-102a333b elementor-widget elementor-widget-heading\" data-id=\"102a333b\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">4. Remote working policy and risk analysis<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-95aaa6b elementor-widget-divider--view-line elementor-invisible elementor-widget elementor-widget-divider\" data-id=\"95aaa6b\" data-element_type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;fadeIn&quot;,&quot;_animation_delay&quot;:300}\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-31e48212 elementor-widget elementor-widget-text-editor\" data-id=\"31e48212\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The supervised entity must perform a <strong>Risk analysis<\/strong> to identify the risks inherent in the implementation of teleworking. It must also implement <strong>mitigation measures<\/strong> aimed at keeping residual risks within acceptable limits based on its <strong>Risk appetite<\/strong> (Risk Appetite). Risk analysis and the implementation of mitigation measures must be <strong>formalised and regularly reviewed<\/strong> by the entity.<\/p><p>The Board of Directors must formalise a <strong>Remote working policy<\/strong> which must be reviewed annually based on risk analysis. Point 32 of CSSF Circular 21\/769 indicates a de minimis list that must be included in this policy.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7b820c60 elementor-widget elementor-widget-heading\" data-id=\"7b820c60\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">5. Security Policy<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2b8e0639 elementor-widget-divider--view-line elementor-invisible elementor-widget elementor-widget-divider\" data-id=\"2b8e0639\" data-element_type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;fadeIn&quot;,&quot;_animation_delay&quot;:300}\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6518ea2b elementor-widget elementor-widget-text-editor\" data-id=\"6518ea2b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The entity must formalise a <strong>Security policy<\/strong> This policy, which must be approved by the Board of Directors, defines the principles and rules applicable to teleworking in order to protect the confidentiality, integrity and availability of data, information and ICT.<\/p><p>The <strong>access rights<\/strong> Access rights granted to teleworkers must be in line with the risk analysis and security policy. These access rights must be reviewed at least annually (semi-annually for privileged users).<\/p><p>Furthermore, the entity must ensure that it keeps the <strong>control<\/strong> on the <strong>devices for remote connection<\/strong> to ICT systems. In this context, the use of personal devices must be restricted to low-risk activities and must be subject to specific risk analysis.<\/p><p>The components of the\u2019<strong>Remote working infrastructure<\/strong> must, at all times, be <strong>secure<\/strong> and <strong>controlled<\/strong>.
