Definition of teleworking according to CSSF Circular 21\/769 as amended<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-56c44a2a elementor-widget-divider--view-line elementor-invisible elementor-widget elementor-widget-divider\" data-id=\"56c44a2a\" data-element_type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;fadeIn&quot;,&quot;_animation_delay&quot;:300}\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7ffd303b elementor-widget elementor-widget-text-editor\" data-id=\"7ffd303b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Circular CSSF 21\/769 as amended introduces <strong>Cumulative conditions for defining the concept of teleworking<\/strong> :<\/p><ol><li>The work must be provided by means of <strong>information and communication technologies<\/strong> (TIC) on <strong>accord <\/strong>preliminary of the\u2019<strong>employer<\/strong> ;<\/li><li>remote working basis <b>voluntary base<\/b> (it is advisable to obtain the express and informed consent of the employee); ;<\/li><li>The tasks must be carried out within the framework of <strong>working hours<\/strong> defined and in a <strong>Predetermined place different from the employer's premises<\/strong>.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1fdb9ac5 elementor-widget elementor-widget-text-editor\" data-id=\"1fdb9ac5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Any task carried out as part of BCP\/DRP activation does not fall within the definition of remote working and is therefore not covered by CSSF Circular 21\/769 as amended.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6451a7f5 elementor-widget elementor-widget-spacer\" data-id=\"6451a7f5\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3490270 elementor-widget elementor-widget-heading\" data-id=\"3490270\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">3. Remote working policy and risk analysis<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-53ee764c elementor-widget-divider--view-line elementor-invisible elementor-widget elementor-widget-divider\" data-id=\"53ee764c\" data-element_type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;fadeIn&quot;,&quot;_animation_delay&quot;:300}\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-348707f9 elementor-widget elementor-widget-text-editor\" data-id=\"348707f9\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The supervised entity must perform a <strong>Risk analysis<\/strong> to identify the risks inherent in the implementation of teleworking. It must also implement <strong>mitigation measures<\/strong> aimed at keeping residual risks within acceptable limits based on its <strong>Risk appetite<\/strong> (Risk Appetite). Risk analysis and the implementation of mitigation measures must be <strong>formalised and regularly reviewed<\/strong> by the entity.<\/p><p>The Board of Directors must formalise a <strong>Remote working policy<\/strong> which must be reviewed annually based on risk analysis. Point 32 of CSSF Circular 21\/769, as amended, indicates a de minimis list that must be included in this policy.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3e925785 elementor-widget elementor-widget-heading\" data-id=\"3e925785\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">5. Security Policy<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2db9404f elementor-widget-divider--view-line elementor-invisible elementor-widget elementor-widget-divider\" data-id=\"2db9404f\" data-element_type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;fadeIn&quot;,&quot;_animation_delay&quot;:300}\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-115b0655 elementor-widget elementor-widget-text-editor\" data-id=\"115b0655\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The entity must formalise a <strong>Security policy<\/strong> This policy, which must be approved by the Board of Directors, defines the principles and rules applicable to teleworking in order to protect the confidentiality, integrity and availability of data, information and ICT.<\/p><p>The <strong>access rights<\/strong> Access rights granted to teleworkers must be in line with the risk analysis and security policy.
